Are Robocalls Harassing You?
You Have Rights—Take Action with Las Vegas Creditor Abuse Attorneys!
Telemarketing has been a nuisance for consumers for years, and robocalling, in particular, has become especially bothersome in recent years. At least, with telemarketers, you are speaking with a live person, but robocalls can be generated at the push of a button and are often computer-operated. There are laws in place to prohibit annoying and harassing robocalls.
These laws are part of the Telephone Consumer Protection Act (TCPA), which restricts telephone usage for solicitation purposes. The TCPA also extends to fax messages, voicemails, and text messages as well. If you have received any form of communication in this way, the sender must not violate the laws. This also applies to creditor and collection phone calls. Also, the individual must provide written permission to be contacted.
What Actions Are Considered Unlawful?
Using artificial voices or pre-recorded messages is one of the trademarks of robocallers. They may call regularly, perhaps multiple times in a day, and may even call in the early morning hours or late at night. Telemarketers and credit agencies must frequently check who is registered on the national Do Not Call Registry and keep track of numbers on that list. If they fail to do this, and contact someone whose number is registered, they may be considered in violation.
Robocalling has become increasingly more prevalent, thanks in part to our dependence on computers. Computer-generated calling is quick and easy for solicitors, but may also be illegal. At the push of a button, a robocall can be generated and can make thousands of phone calls in under a minute. This is cost-effective for the company and they are difficult to keep track of. Robocalls may use fake numbers or your caller ID may show "Private" or an "Unknown" number.
What Can I Do to Protect Myself?
If you pick up the phone and a robocall recording begins playing without your consent, this is illegal. There are numerous regulations to prohibit this type of behavior. For every violation, you can sue the solicitor for as much as $1,500 per call and even seek injunction to stop harassment.
